Sign your waiver in a few easy steps.

1. Assumption of Risk

I, the undersigned ("Guest"), understand that entering the Cat Room at Columbus Tribal Blend Cat Cafe ("the Cafe"), located in Columbus, Indiana, involves interaction with live cats. I voluntarily assume all associated risks, including scratches, bites, nips, allergic reactions to cat dander, fur, saliva, litter dust or other allergens; disease or parasite exposure despite regular veterinary care; tripping, slipping or falling caused by cats moving unpredictably; damage to personal property; and injury involving cat furniture, climbing structures, toys or fixtures.

2. Release and Waiver of Liability

In consideration of being permitted entry, I release, waive, discharge and agree not to sue Columbus Tribal Blend Cat Cafe, its owners, operators, employees, volunteers, agents, partners, affiliates and successors (the "Released Parties") from claims, demands, liabilities, damages, costs or expenses, including attorney fees, arising from personal injury, illness or death; property damage or loss; allergic reactions; or negligence of the Released Parties, except gross negligence or willful misconduct. Pursuant to Indiana Code section 34-51-2, comparative fault shall be apportioned as provided by law.

3. Indemnification

I agree to indemnify, defend and hold harmless the Released Parties from claims, losses, damages and expenses brought by me, my minor child or a third party arising from our entry into the Cat Room, including damage to cats or Cafe property.

4. Health and Allergy Acknowledgment

I represent that I am in good health or enter at my own risk; I have disclosed known allergies to staff; I understand the Cafe cannot guarantee a hypoallergenic environment; I am responsible for my own allergy medication; and I have not been exposed to a communicable disease transmissible to animals.

5. Cat Room Rules

I will follow all posted rules and staff instructions. I will not pick up or carry cats without permission, handle cats roughly, disturb sleeping cats, feed outside food, use flash photography or allow cats to escape. I will supervise children at all times, sanitize my hands, keep doors closed and promptly report scratches, bites or other incidents. Violation may result in removal without refund.

6. Minors

A parent or legal guardian must sign for a guest under 18, accept full responsibility, accompany the minor at all times and indemnify the Released Parties. Consistent with Indiana Code section 34-31-4, parents are responsible for damage caused by their minor children. Children under 4 are not permitted. Children ages 4 through 9 must remain within arm's reach of a guardian.

7. Media Release

I authorize the Cafe to photograph or record my or my minor guest's likeness for Cafe marketing and social media without compensation. The electronic form's media permission starts selected, and I may decline by clearing that choice before signing or by notifying staff that I do not wish to be photographed.

8. Personal and Cafe Property

The Cafe is not responsible for damage, loss or theft of personal property. I am financially responsible for damage that I or my minor child causes to Cafe property, furnishings or cats.

9. Dispute Resolution and Governing Law

This waiver is governed by Indiana law and applicable ordinances of Columbus and Bartholomew County. Disputes shall first be submitted to mediation, then binding arbitration in Bartholomew County under the Indiana Uniform Arbitration Act, Indiana Code section 34-57-2. Each party bears its own costs unless otherwise awarded.

10. General Provisions

Invalid provisions do not affect the remaining terms. This is the entire agreement and supersedes prior agreements concerning Cat Room entry. It binds the Guest and the Guest's heirs, executors and assigns. I sign voluntarily and without coercion. This waiver remains valid for one year from signing.

11. Electronic Records and Signatures

I consent to complete this transaction electronically and to use an electronic signature. I intend my drawn electronic signature and submission to have the same force and effect as a handwritten signature. I can review this waiver before signing, download or print the confirmation record, request a paper copy from the Cafe and decline electronic signing by asking staff for a paper waiver.
